Einladung zur konstituierenden Sitzung des Sonderausschusses NA 063 BR-02 SO „Forensik“

Sehr geehrte Damen und Herren, aufgrund eines Antrages des Polnischen Normungsinstitutes (PKN) hat die Europäische Normungsorganisation CEN (Technical Board, CEN/BT) beschlossen, ein Komitee „Forensic Science Services“ einzurichten. Entsprechend Resolution BT13/2012 wurde das Technische Komitee CEN/TC 419 „Project Committee –Forensic Science Services“ eingerichtet mit der Aufgabe, Europäische Normen, wie im Antrag von PKN vorgeschlagen (siehe N 05), zu erarbeiten. Das Sekretariat wird PKN übertragen; das Arbeitsprogramm soll bis Ende November 2012 dem CEN/BT zur Bestätigung vorgelegt werden. Parallel zu den Aktivitäten auf Europäischer Ebene, liegt dem Internationalen Normungsinstitut ISO ein neuer Projektantrag vom Australischen Normungsinstitut (SA) für eine Norm zum Thema „Minimizing the risk of contamination in products used to collect and analyse biological material for forensic DNA purposes” vor.

Die Geschäftsleitung des DIN hat im Normenausschuss Medizin (NAMed) einen Sonderausschuss gegründet, der mit der Spiegelung der Arbeiten des neuen CEN/TC 419 und der Arbeiten auf Internationaler Ebene beauftragt wird. Der Sonderausschuss soll die Arbeiten national begleiten. Dies bedeutet, er koordiniert in diesem Arbeitsbereich alle Arbeiten und Stellungnahmen, stimmt über die Zusammensetzung der deutschen Delegierte/Experten ab und bringt die deutschen Interessen in die Europäische und Internationale Normung ein.

Im Anschluss an den Workshop "Forensik" (Einladung und Tagesordnung siehe N 04) laden wir Sie herzlich zur konstituierenden Sitzung des neuen Sonderausschusses "Forensik" ein. Die Sitzung findet wie folgt statt:

Über die endgültige Zusammensetzung des Ausschusses beschließt dieser auf der konstituierenden Sitzung selbst. Zur zweiten Sitzung können nur autorisierte Personen eingeladen werden.

Den vorläufigen Verteiler für diese Einladung entnehmen Sie bitte Dokument N 02. Wir bitten Sie, sich bis zur konstituierenden Sitzung zu überlegen, ob und ggf. welche weiteren interessierten Kreise in dem Ausschuss vertreten sein sollten (siehe TOP 3.4, N 03). Neben der Konstituierung und der Wahl der Obperson/stellvertr. Obperson steht insbesondere die Festlegung der deutschen Delegation für die erste Sitzung des CEN/TC 419 auf der Tagesordnung. Die konstituierende Sitzung des europäischen Gremiums CEN/TC 419 findet am 23. Oktober 2012 beim PKN in Warschau statt (siehe Einladung und Tagesordnung in N 08). Bitte prüfen Sie, ob Sie grundsätzlich an der CEN-Sitzung teilnehmen würden.

Wir weisen Sie darauf hin, dass alle interessierten Kreise, die im neuen Sonderausschuss mitarbeiten, zur Finanzierung der Geschäftsstellentätigkeit herangezogen werden. Dies geschieht in erster Linie durch die Entrichtung von Förderbeiträgen. Die Vertreter der öffentlichen Hand einschließlich der Hochschullehrer und der Vertreter der öffentlich-rechtlichen gefassten Forschungseinrichtungen sowie der nichtgewerblichen Endverbraucher bleiben frei von der Pflicht zur Beteiligung an der Finanzierung. Detailinformationen zur Finanzierung der Normungsarbeit des DIN stehen Ihnen hier zur Verfügung. SUBJECT
Creation of a new Project Committee on "Forensic science services"

BACKGROUND
On 13 January 2012 PKN submitted a Form A (see Annex 1) to CEN proposing the creation of a new CEN Project Committee in order to develop European Standards on forensic science services.

The Form A envisages the development of one or several European Standard(s), laying down the provisions for a forensic science delivery process, which is initialized at the scene of crime where evidence is collected. The primary intention is to establish a standard for the collection, processing, use and delivery of forensic data. Priority will be given to the development of a standard dealing with the investigation services provided at the scene of the crime Several policy initiatives of the EU Council established a legal framework for cross border cooperation, particularly in combating terrorism and cross-border crime over the last decade. The latest statistics show that more and more criminal activities have a cross-border character and criminal proceedings are nowadays carried out by two or more countries according to the legislation in place.

Mutual recognition among European forensic laboratories would be of direct benefit to the cooperation of countries involved in investigations or court proceedings related to the same offence. Particularly important, every single EU citizen has the right to a fair trial and common standards can guarantee that the rights of the individuals are not violated within the EU area. This is directly dependent on the way the integrity of forensic evidence is secured. The proposed standard(s) will contribute to the efficient cooperation and recognition of investigation in the field of police and judicial cooperation in criminal matters.

BT Members are requested to state explicitly, by means of the commenting field provided in the BT-balloting tool, whether or not they are committed to participate in the work.

By Resolution BT C75/2009, BT approved that both of following criteria are to be met for acceptance of this proposal:

• A two-thirds majority of the votes cast (abstentions not counted) are in favour of the proposal;
• 5 (or more) Members express commitment to participate.

SIS comments on CEN/BT Draft resolution c006/2012: Creation of a new Project Committee on Forensic science services

1) As a general comment, Sweden considers it will be very difficult to standardize all forensics in the near future, given national or regional regulatory requirements for handling inquiries or the accumulative procedures for handling inquiries that are not harmonized with other laboratories. To standardize laboratory tests would involve significant costs due to requirements in updating laboratory equipments and the like. It is possible to have good control of laboratory studies using inter-laboratory tests showing accurate results despite different survey procedures. It might be interesting to have a standard in certain areas such as DNA-free disposables, packaging for the procurement of research material on crime scene and more. A major question is whether it is possible to do a sector-specific standard for the forensic activity that is an EN standard which later may become an ISO standard for the forensic activity. This can cover the work from the crime scene through laboratory and which then results in an expert opinion.

On medical forensics, Sweden is about to launch our quality built in ISO 17025 and ISO 17020 standard within forensic medicine where we ultimately will seek the needed accreditation.

2) On the gathering of information for the prosecution, a common standard could bring benefits in the fight against all cross-border crime (that may be appropriate to prosecute persons in the country other than where the crime was committed and / or parts where the investigation was carried out). A common standard could be a step forward towards this purpose. A second step may be to anchor any common standard in the various European legal systems and to build up trust in the work performed and the results presented by an authority or forensic unit in another country. It is of upmost importance to prevent a common standard to impoverish or worsen existing national quality requirements.v

3) Regarding Computer Security, Sweden will soon be finished with 27 037 which is a first respondence standard. A standard which is precisely to create an International Standard Method with the intention of finding a collection method just to be able to communicate internationally scraped material to law enforcement authorities in any country, law, and technologies. We have deliberately kept us away from the analysis because there are a variety of practices which are accepted in the police community around the world. We had about two difficult working months trying to explain to, e.g. U.S., UK and others that 27 037 was not an analytical standard, but only a first respondence standard. So CEN should check with ISO if they have received signals that it is ok to challenge many established providers and users in this particular area. We would like to receive the following clarifications:

• Is the CEN proposal considering incorporating Computer Security as well?
• In that case, how will the committee go about synchronising with the groups working on Infosec and CSCG (Computer Security Coordination Group).
• If this is the case, why is this a CEN question? It ought to reasonably be an ISO issue. CSCG has the goal to find forms of cooperation between the EU-USA, but it will not be helped if it becomes solely a European standard.

Comment to Creation of a new Project Committee on "Forensic science services", BTC 006/2012, deadline 24th April 2012 from the Netherlands.
NEN supports in principle the Polish proposal for development of standards in the area of forensic science service although it wishes to express the following comments on the proposal:

1. As pointed out in the proposal itself, the proposed standardisation activities are closely linked to European policy-making. According to the Council conclusions on the vision for European Forensic Science 2020, the deadline for publication of a detailed action plan to implement the vision for European Forensic Science 2020 is end of June 2013. The proposed standardisation activities should be carefully aligned with the content and timing of the action plan. Currently, the Member States are preparing their inputs for converging to a common European viewpoint. NEN is convinced that these results will benefit the development of European standards in a more advanced stage, and therefore standards development should not start before the details of the action plan are known.

2. The scope of the standardization work proposed needs to be further clarified. The scope description is very broad, and raises the question if the standard will be of a more generic (e.g EN ISO 17025) or more specific nature. In the latter case the Netherlands would like to know to what extend (minimum) requirements, recommendations and/or specifications of processes, persons and products will be detailed in (some of the) future European standards. In any case it will be important to consider the practicability of future standards, especially regarding scene of crime related activities. NEN is prepared to contribute to the drafting of a more detailed work plan for the proposed PC.

Danish comments on Draft BT C6/2012

DS cannot support the creation of a new PC on Forensic science services because ISO/IEC 17020 and ISO/IEC 17025 are recognized by ILAC for use within "Forensic science services". European Accreditation Co-operation (EA) leads a global working group ILAC WG 10 which prepares a common guideline for the mentioned standards application within "Forensic science services". This guideline "Modules in the Forensic Process" is in process and is expected to be approved this summer for publication later this year. Therefore we do not see the need for special European Standards within the field in question.

Draft resolution BT C 6/2012: Creation of a new Project Committee on "Forensic science services"

BSI votes approval to draft resolution BT C 6/2012 with the following comments.

UK stakeholders support the proposal to form a CEN Project Committee for development of standards in this area. However, the UK view is that forensic science is ultimately a global issue and therefore standards on this subject are best managed through international standards (ISO) but possibly initially developed from European standards in conjunction with wider international partners.

BSI recommends a liaison (preferably via the Vienna Agreement) with ISO as and when a suitable international technical committee exists which can then be linked to the CEN committee. It should also be noted that other national standards in this area are already under development, such as those close to publication by Standards Australia.

In the UK there are a number of Forensic Science National Occupational Standards (NOS) in place, which are the practitioner competence standards used across the UK, and which we would be happy to offer to this CEN PC as part of the standards development process. The UK National Occupational Standards map directly onto a generic forensic process as detailed in figure 1 below:
